Buying a digital download from Eye of the Guide gives you a personal licence to use the photograph on your own screens, for example as wallpaper or a screensaver. The photograph stays the property of the guide who took it. You cannot sell it, share the file, or use it commercially.

  • Use it on your own devices, as wallpaper, a screensaver, or on a digital photo frame.
  • Keep the file for your own use only. Do not pass it on or upload it for others.
  • Lodges, hotels, restaurants, workplaces open to clients, publishers and brands need a commercial licence. Email hello@eyeoftheguide.com.

1. About these terms

These terms are an agreement between you and Eye of the Guide (“we”, “us”) for a digital download you buy from eyeoftheguide.com. By placing your order, you accept them.

In these terms, “Image” means the photograph you bought, including its title, caption and metadata. “Photographer” means the guide who took it, as named on the product page. “File” means the digital copy we supply.

2. Your licence

When you pay, we grant you a personal, non-exclusive, non-transferable licence to use the Image on your own screens, on these terms. It is worldwide and lasts for as long as the Photographer’s copyright does, unless it ends under section 7. It covers the following.

  • Downloading the File and keeping backup copies on your own devices.
  • Displaying the Image on your own screens, such as a computer, phone, tablet, TV or digital photo frame.
  • Using the Image as wallpaper or a screensaver on your own devices.
  • Cropping, resizing and adjusting brightness or contrast where needed to fit your screen.

The licence covers one Image, for you as an individual. It does not cover other Images by the same Photographer.

3. What is not included

The licence does not allow you to do any of the following.

  • Sell, rent, lend, sublicense or give away the File or any copy of it.
  • Use the Image commercially, including in advertising, packaging, websites, publications, or promotion for a business or brand.
  • Display the Image in a lodge, hotel, restaurant, gallery, shop, or any workplace open to the public or to clients.
  • Put the Image on physical products such as mugs, cushions, phone cases or clothing, or on made-to-order items.
  • Upload the File to stock libraries, image marketplaces, wallpaper sites or file-sharing services, or post the full-resolution File online.
  • Use the Image to train, fine-tune or test machine learning or generative AI models, or to produce AI-generated copies or variations of it.
  • Turn the Image into an NFT or any other digital collectible.
  • Remove the Photographer’s credit, copyright notice or file metadata, or present the Image as your own work.
  • Combine or alter the Image into a new work that you share or sell.
  • Use the Image unlawfully, or in a way that suggests the Photographer or Eye of the Guide endorses a product, service or cause.

4. Ownership and credit

The Photographer owns the copyright in the Image and keeps all rights in it. You get a licence, not ownership. We sell the Image under a non-exclusive licence from the Photographer, who may also license it to others.

We do not edit or regrade Images. The File is supplied as the Photographer made it.

If you show the Image to others online, for example in a screenshot of your desktop, please credit the Photographer and tag @eye.of.the.guide, for example: Photo by [Photographer name] / @eye.of.the.guide. This is a request, not a condition of your licence.

All rights not expressly granted are reserved.

5. Delivery, download and cancellation

We email your download link to the address you used at checkout. Links are tied to your order, so please do not share them. Download the File promptly and save it to your own storage, because links may expire or be limited in number.

If a link fails or the File is damaged, email hello@eyeoftheguide.com and we will fix it or resend it.

A digital file is supplied immediately. If you are a consumer in the UK or EU, your 14-day right to cancel ends once the download begins, provided you agreed to this when you ordered. This does not affect your legal rights if the File is faulty or not as described.

6. Our promises and liability

We promise that we have the Photographer’s permission to license the Image to you. To our reasonable knowledge, the Image does not infringe anyone else’s rights.

The File is supplied as the Photographer made it, and we cannot promise how the Image will look on your screen, because displays and settings vary. We take care to supply clean files, but please scan any download with your usual security software.

Nothing in these terms limits your legal rights as a consumer. Nor does it limit our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. Beyond that, our total liability to you for any one Image is limited to the price you paid for it, and we are not liable for indirect or consequential loss.

7. If these terms are broken

If you use the Image outside this licence and it can be put right, we will email you and you will have 14 days to stop and fix it. If it cannot be put right, such as selling the File, or you do not fix it in time, the licence ends.

When the licence ends, you must stop using the Image and delete all copies of the File. We may also claim a reasonable licence fee for any use outside these terms, in addition to any other remedy the law gives us.

If you see the Image used without permission, please tell us at hello@eyeoftheguide.com. The Photographer decides what action to take.

8. General terms and contact

  • The Photographer named on the Image may enforce these terms directly against you.
  • You may not transfer or sublicense your licence. We may transfer our rights under these terms to another business.
  • We may send notices to the email address you gave when you ordered. You can write to us at hello@eyeoftheguide.com.
  • If any part of these terms is found to be unenforceable, the rest stays in force.
  • These terms, together with your order, are the whole agreement about the Image. We may update them for future purchases, but the version supplied with your download applies to your purchase.
  • These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere, you keep any mandatory consumer protections of your home country.
